Website & Venue Legal Policies
Effective October 30, 2026Magical Backyard Parties Inc.7244 Quartz Ave, Winnetka, CA 91306(818) 489-5301magicalbackyardparties@gmail.com
Part I — Website Terms of Use & Venue Reservations
1. Operator; acceptance; eligible booking party
This website and the event venue services described on it are operated by Magical Backyard Parties Inc. (“Company,” “we,” “us”). By using the website, you agree to these Website Terms. A venue reservation becomes binding only after we issue written booking confirmation and the renter accepts the separate event agreement and its disclosed charges. Only persons 18 or older may submit reservations, enter contractual commitments, or provide legally binding permission on behalf of a child. Parents/guardians remain responsible for permission they have authority to give.
2. Services, prices, capacity and availability
We offer private indoor and outdoor event space for celebrations, with optional catering and extras by written agreement. Website illustrations, descriptions, packages, guest limits and prices are informational and subject to accurate availability, staffing, legal occupancy, safety requirements and written confirmation. The website currently lists a three-hour minimum, starting at $800 with $250 per additional hour, and up to 50 total guests including children and adults. Any larger event requires our prior written approval and applicable legal authorization; online inquiries do not reserve a date. Taxes, deposits, overtime, cleaning, damage, third-party and other fees must be explicitly disclosed before agreement; no undisclosed charge is authorized by this policy.
3. Deposit, cancellation, rescheduling and refunds
A written event confirmation must separately state the payment schedule, deposit characterization, cancellation and rescheduling deadlines, refund conditions, weather/air-quality response, force-majeure process and any reasonable actual-cost deductions. If there is no agreed written policy, this document does not create an automatic nonrefundable deposit or forfeiture. We will not describe a fee as nonrefundable or retain funds contrary to applicable California law. Credit-card disputes and statutory rights remain available where required by law.
4. Guest safety; adult supervision; age suitability
The renter is responsible for notifying attendees of venue rules and ensuring adequate, continuous supervision of all children by their parents, legal guardians or responsible adults. On-site personnel assist with the venue but are NOT babysitters, childcare providers, lifeguards or a substitute for parental supervision. Children must use play equipment only in an age-, size- and ability-appropriate manner and obey posted instructions. No rough play, dangerous climbing, misuse of slides, running in restricted areas or obstruction of exits. Tell staff promptly of hazards, injuries, spills or damaged equipment. In a serious emergency call 911 immediately.
5. Venue rules; accessibility and prohibited conduct
Follow lawful staff directions, posted occupancy and safety rules, fire-code requirements, noise limits, and reasonable operational restrictions. No weapons, illegal substances, dangerous equipment, smoking/vaping where prohibited, unapproved open flames, or conduct endangering others. Decorations must not damage structures, obstruct exits or create fire hazards. Pets, vendors, inflatables, generators, amplified entertainment and special installations require prior written approval as applicable. Contact us in advance for reasonable accessibility accommodations; applicable disability-access rights are not waived.
6. Property, damage, personal belongings and incident reporting
Guests are responsible for reasonable damage they or their invitees cause, subject to applicable law and proof of the loss. Do not leave valuables unattended. The Company does not assume custody of personal property unless expressly agreed in writing. Report injuries or property damage promptly, request incident documentation, and preserve relevant evidence. Nothing in these Terms removes the Company’s duties under applicable law.
7. Assumption of ordinary recreational risks; nonwaivable rights
Slides, climbing structures, games, outdoor weather, food preparation and recreational activity involve ordinary foreseeable risks such as falls, collisions, heat exposure or minor injury. Participants and supervising adults should exercise care and follow posted rules. To the extent legally permissible, a separate, conspicuous, voluntary event-specific release may address ordinary negligence and inherent recreational risks. These Website Terms alone are not a blanket release for minors. No term releases fraud, willful injury, unlawful conduct, gross negligence where prohibited, or any right that cannot lawfully be waived (including California Civil Code section 1668).

Part II — Privacy Policy & California Privacy Rights
1. Scope and contact
This Privacy Policy describes proposed website, inquiry, event, photo, and security-data handling practices by Magical Backyard Parties Inc., 7244 Quartz Ave, Winnetka, CA 91306, (818) 489-5301, magicalbackyardparties@gmail.com. It covers information collected online and in connection with venue bookings. Where California Consumer Privacy Act/Privacy Rights Act (CCPA/CPRA) thresholds apply, statutory notices and rights control; other privacy and consumer protection laws may apply even when those thresholds do not.
2. Categories of data and sources
- Identifiers/contact: name, email, telephone number, postal address if furnished.
- Reservation information: event date/time, guest count, event type, preferences, messages, vendors and catering choices.
- Uploaded content: photos or ideas voluntarily supplied through a booking form; please do not upload children’s identifiable photos without appropriate permission.
- Technical/security: IP address, browser/device data, server logs, cookies required for website operation, timestamps, and spam-prevention records, if actually collected.
- Payments: transaction details and limited payment status; payment-card numbers should be handled by the designated payment processor rather than stored by the Company.
- On-premises cameras, entry logs and incident records, ONLY if the venue actually operates those systems.
- Sensitive needs: food allergies or accessibility requests only when voluntarily supplied and reasonably necessary to provide requested services.
3. Purposes; restricted collection; retention
Use information to respond to inquiries, confirm reservations, administer services, arrange authorized vendors/catering, prevent fraud, maintain safety, communicate essential updates, resolve disputes, meet legal obligations and honor privacy requests. Collect no more than reasonably necessary. Retain each category only as long as necessary for these purposes, accounting for tax, contracts, chargebacks, safety incidents and legal holds.
4. Disclosures; sale/sharing and advertising
Information may be disclosed to service providers such as web hosts, form/email platforms, approved catering vendors, payment processors, security services and professional advisers, subject to appropriate contractual safeguards, or when legally required. Company policy is not to sell customer information, and the current site says it does not sell or share inquiry data. If legally defined “sale” or cross-context behavioral-advertising “sharing” occurs and CCPA applies, provide required opt-out tools and honor qualifying opt-out preference signals.
5. California consumer rights
Where the CCPA/CPRA applies, eligible California residents may request access/knowledge of collected information, correction of inaccuracies, deletion subject to exceptions, information about disclosures, and opt-out of sale or sharing; they may also have rights to limit certain uses of sensitive personal information and not to be discriminated against for exercising privacy rights. Requests can be made by calling (818) 489-5301 or emailing magicalbackyardparties@gmail.com. We will verify identity or authorized agent status in a proportionate manner, respond within applicable legal deadlines and explain any lawful denial.
6. Children’s privacy
Our reservation and inquiry tools are intended for adults. We do not knowingly solicit direct online submissions from children under 13. We ask adults not to send a child’s name, face, location or other identifiable information unless reasonably needed and appropriately authorized. If we learn that personal information was collected directly from a child in violation of applicable law, we will investigate and delete it as appropriate. COPPA requirements may apply if a service is directed to children under 13 or if we knowingly collect online personal information directly from them; a website disclaimer alone does not remove those duties.
7. Security, cookies, third parties and updates
We use reasonable administrative, technical and physical safeguards appropriate to the data and risks, such as access limitations and secure transmission where implemented. No website, storage system or surveillance arrangement is completely secure. The site uses cookies necessary for its functioning according to its current privacy page; any new analytics or advertising tools require policy review. External sites and payment providers may have their own policies. Material changes will be posted with an updated effective date and additional notice where required.
Questions about this policy? Call (818) 489-5301 or email magicalbackyardparties@gmail.com.
Part III — Photography, Video, Minors & Media Consent
1. Website image-rights statement — contingent on actual documented consent
Company policy is to post only photos, videos, audio, testimonials and other content for which it owns rights or has obtained the necessary licenses, releases and permissions. For images depicting identifiable children, Company policy is to obtain documented authorization from each child’s parent or legal guardian before publication for promotional use. For identifiable adults, Company policy is to secure appropriate permission or a valid legal basis. We maintain records of authorizations and honor applicable requests to stop future uses.
2. No automatic photo release by attendance or reservation
Attendance, purchasing a ticket, renting the venue, or agreeing to website terms does NOT, by itself, grant permission for us to use a child’s identifiable image in advertising. Promotional photography requires a separate, informed, affirmative release signed by a parent/guardian with authority for the particular child; adults can separately consent for themselves. Consent may be declined without losing ordinary venue access. A group organizer cannot sign for other families’ children without legal authority.
3. Notice, withdrawal, and boundaries
We will provide clear advance notice of planned promotional photography and reasonable arrangements for guests who decline. We will not intentionally post children’s full names, school details, precise locations, sensitive personal information or humiliating imagery with promotional photos. Authorized media may appear on the website, official social pages, brochures or specified channels stated on the signed release. A person may request removal of Company-controlled posts by contacting us; we will act reasonably on verified requests, but cannot guarantee removal of third-party copies previously shared.
4. Guest photography and recordings
Guests may take ordinary personal photos with respect for others’ privacy and legal rights. A guest may not photograph another child in a manner that violates the child’s privacy, nor use others’ likenesses commercially without permission. Photography in restrooms, changing areas or other places where privacy is expected is strictly prohibited. Any surveillance or security camera recording is for legitimate safety/security purposes and is not automatically authorized for marketing.
5. Copyright, submitted images and takedown
The person uploading any image represents that they have lawful authority to share it for the limited purpose of responding to their inquiry. Submission does NOT grant us a public advertising license. Copyright owners or people featured in content can request review by phone/email above; include the URL and proof of rights. We will investigate and remove content where appropriate or legally required.

Part IV — Catering, Food Safety & Event Disclaimers
1. Optional catering and quotations
Catering is optional and arranged only upon customer request and separate written confirmation. Menus, per-person pricing, taxes, gratuities, delivery, setup, cancellation and responsible provider must be set out in the catering quote. Substitutions for availability must be communicated. Catering may be provided by a separate licensed/approved vendor;
2. Licensing, allergies and food handling
Company and caterers will comply with applicable health permits and food-safety requirements for the services actually performed. Clients should communicate known food allergies and dietary restrictions before confirming service. Ingredients, preparation methods and cross-contact limitations must be verified with the actual food provider; do not promise allergen-free food absent verified controls. Food served or brought by guests must be handled safely. Parents/guardians supervise children around food, hot surfaces, utensils, beverages and potential choking hazards.
3. Venue and website disclaimer
Photos, renderings, menu examples, availability, weather displays and descriptions are informational and may not show exact event-day conditions. Weather forecasts are third-party information; staff may close outdoor areas for heat, air quality, unsafe conditions or official directions. We may impose proportionate safety restrictions as reasonably necessary. No promise of accident-free use, constant camera coverage or guaranteed prevention of third-party misconduct is made. Nothing disclaims nonwaivable duties, required warranties or legally protected consumer rights.
Questions about this policy? Call (818) 489-5301 or email magicalbackyardparties@gmail.com.
Part V — California Arbitration & Dispute Resolution
1. Good-faith informal resolution
Before filing arbitration, either party may send written notice describing the dispute and requested relief to Magical Backyard Parties Inc., 7244 Quartz Ave, Winnetka, CA 91306, with a copy to magicalbackyardparties@gmail.com. The parties will attempt informal resolution for 30 days, unless urgent relief or a filing deadline requires earlier action. This step does not bar legally required statutory processes or toll deadlines except where a binding written agreement or law provides.
2. Agreement to individual arbitration (if expressly accepted)
Except for exclusions below and only to the extent applicable law permits, disputes arising from an accepted booking contract or related services between a consenting adult renter and Company will be decided by binding individual arbitration administered by the American Arbitration Association (AAA) under its applicable Consumer Arbitration Rules, rather than by a judge or jury. The Federal Arbitration Act governs interpretation and enforcement to the extent applicable; otherwise applicable California law applies. A court decides enforceability of this arbitration agreement unless law requires otherwise.
3. Fair procedure and costs
Hearings will occur in Los Angeles County, California, or remotely/by documents where the rules permit and fairness warrants. The arbitrator may award any individual relief available in court under governing law. Company will pay arbitration fees to the extent required by AAA consumer rules or applicable law, and will not require the consumer to pay fees they would not lawfully bear. The arbitrator will issue a reasoned written award upon request in accordance with rules.
4. Exclusions and legally protected claims
Either party may bring eligible individual claims in small-claims court. Either party may seek temporary or preliminary court relief when legally available. Claims, requests for public injunctive relief, regulatory complaints, and other matters that may not lawfully be compelled to private arbitration remain available in the required forum. This clause does not bind non-signing guests, children, or third parties merely by attendance; their rights are determined independently under applicable law.
5. Individual proceedings and class treatment
Only to the extent permitted by governing law, claims subject to arbitration proceed individually rather than as a class or representative arbitration. If a restriction on representative or public relief is unenforceable as applied to a claim, the relevant claim or remedy shall proceed in the competent court to the extent required, without extinguishing nonwaivable rights.
6. Right to opt out
A renter who separately accepts an agreement containing arbitration may opt out by emailing magicalbackyardparties@gmail.com or mailing the Company at the above address within 30 days after acceptance, identifying their name, booking date and intent to opt out of arbitration. Opting out does not cancel the event reservation or change its price. Company shall maintain a record of opt-outs.

Part VI — Website Disclaimers & General Terms
1. Intellectual property and permitted website use
Website wording, original branding, graphics, photos and designs are owned by Company or used under permission and protected by applicable rights. No copying for commercial use, impersonation, malicious scraping, exploitation of security vulnerabilities or interference with operation is permitted. Ordinary noncommercial browsing and sharing website links are allowed.
2. Limits; indemnification; applicable law
To the extent permitted by law, Company is not liable for speculative website-only losses caused by interruptions or third-party systems; this statement does not exclude liability for personal injury, statutory violations, fraud, willful misconduct or otherwise nonwaivable obligations. Any indemnification by a renter must be limited to third-party claims caused by the renter’s proven unlawful conduct or contractual breach, subject to California law, and must not cover Company’s own unlawful conduct. California law governs except where federal law preempts it. Any court proceedings properly outside arbitration will be in a court of competent jurisdiction in Los Angeles County, unless law requires otherwise.
3. Severability; changes; contact
If a provision is unenforceable, the remainder survives insofar as lawful and consistent with the parties’ bargain. Posted revisions apply prospectively; material changes to accepted bookings require agreement or a lawful contractual basis. Questions: (818) 489-5301, magicalbackyardparties@gmail.com, 7244 Quartz Ave, Winnetka, CA 91306.
